Following Paxton's lawsuit, the U.S. Department of Justice agreed not to enter polling stations in Texas on Election Day

The U.S. Department of Justice reversed course and agreed not to send poll watchers to polling stations in eight Texas counties, including Dallas, on Election Day, according to court documents.

The decision came after Attorney General Ken Paxton sued the agency after the Justice Department announced Friday that it would deploy federal election monitors to 86 jurisdictions in 27 states on Tuesday. The Department of Justice regularly visits voting precincts to ensure compliance with federal election law.

The lawsuit announced by Paxton on Monday evening was filed in federal court. Paxton argued that no federal law authorizes federal agents to monitor state elections when state law prohibits it.

According to a new court filing, the Justice Department has agreed that poll watchers will remain at least 100 feet outside of polling places and central counting locations, as required by Texas law, and will not “obstruct voters seeking to cast their ballot,” as has long been the practice is practice, but being able to talk to voters who are willing to do it.

“Texans run the elections in Texas, and we will not be bullied by the Department of Justice,” Paxton said in a news release Tuesday. “The Justice Department knows it has no authority to oversee Texas elections and backed down when Texas stood up for the rule of law. No federal agent will be allowed to interfere in Texas’ free and fair elections.”

The lawsuit against the DOJ will be pending until the election is completed to ensure the department's compliance, the release said.
