The claim: The image shows a CNN graphic of the Texas presidential election results for Harris and Trump

A Nov. 3 Instagram post (direct link, archive link) shows an image from a CNN broadcast with alleged vote counts from Texas for Vice President Kamala Harris and former President Donald Trump in the 2024 presidential election. The image shows Harris leading Trump.

The caption of the post reads: “#Texas is going blue. It works. The illegals vote. Where are the #Texans?”

A similar Instagram post was liked more than 2,000 times before it was deleted.

A CNN spokesman said the graphic was fake and would not be broadcast on the network. Texas will begin releasing election results after polls close on November 5th.

Emily Kuhn, a spokeswoman for CNN, said the image did not show a genuine report from the network.

“This image is completely fabricated and manipulated and has never aired on any CNN platform,” Kuhn said in an email.

There is no credible evidence that CNN published vote counts from Texas for Harris and Trump before Election Day. As of Nov. 4, the state had not yet begun releasing results from the Nov. 5 general election.

Texas is expected to begin releasing results after polls close at 7 p.m. local time on Election Day, the Texas Tribune reported.

The New York Times presidential poll averages show Trump holding a lead over Harris in Texas since at least September 19.

The Instagram post talks about “illegal voting,” but non-citizens are not allowed to take part in federal elections. Evelyn Cruz, a professor of clinical law at Arizona State University, previously told USA TODAY: “While it does happen that non-citizens attempt to register to vote, it is often a misunderstanding and rarely seen we non-citizens who actually voted.”

USA TODAY reached out to the Instagram user who shared the post for comment but did not immediately receive a response.

AFP and PolitiFact also debunked the claim.
